We get so many questions about traveling with CBD or hemp based products like Delta-9 THC and we have some answers for you! How can I fly with THC? Driving with your products is one thing but flying is an entirely different subject. Flying commercially is using a federally regulated service. Even though it is a privately owned business, the airline, the facilities and the security is federally regulated. So how can I legally fly with legal THC products that are under .3%? That being said, here is what you need to know.

In general, it is not legal to bring marijuana or any cannabis-infused products on a commercial flight, even if it is legal in both your departure and arrival locations. The TSA is the governing body responsible for screening passengers and their luggage, and it is illegal under federal law to possess or transport marijuana, including THC products , across state lines or federal property.

If you are traveling within a state where marijuana is legal, some airlines may allow you to carry small amounts of legal THC products in your carry-on baggage. However, it is always best to check with the airline to see what their policy is before you travel. Additionally, you should always make sure that your THC product is in its original packaging and has proper documentation probing that it was purchased legally.

(See the Agriculture Improvement Act of 2018, Pub. L. 115-334.) TSA officers are required to report any suspected violations of law to local, state or federal authorities.

TSA’s screening procedures are focused on security and are designed to detect potential threats to aviation and passengers. Accordingly, TSA security officers do not search for marijuana or other illegal drugs, but if any illegal substance is discovered during security screening, TSA will refer the matter to a law enforcement officer.”

In summary, while there is a possibility that you might be able to fly with legal THC products within a state where it is legal, it is generally not recommended, and you should be prepared to face consequences if caught carrying cannabis products.
