Most products that contain Delta 8 are comprised of the compound derived from CBD hemp, making it primarily legal. Based on the 2018 Farm Bill‘s definition of hemp, the state of Indiana has created a legal distinction in their Controlled Substance Act between cannabis products and hemp products; therefore, Delta 8 products are legal. 

The Farm Bill declares that anything with a concentration of Delta 9 that is less than 0.3% is legal in the eyes of federal law. Due to products that contain Delta 8 not containing any Delta 9, these Delta 8 products are federally legal.
